Federal Court Grants Utah More Time to Prepare for Amendment 3 Appeal

A federal appeals court has granted Utah's request for more time to prepare opening arguments in defense of the state's same-sex marriage ban. A lawyer for the plaintiffs in the Amendment 3 case happened to be speaking at the University of Utah Law School today, and said she was disappointed by the extension, but not discouraged.

U.S. Supreme Court Halts Gay Marriage in Utah

The U.S. Supreme Court granted Utah’s request to stay a federal judge’s ruling that overturned the state’s law banning same-sex marriage.  The stay effectively stops county clerks from issuing any more marriage licenses to gay couples for now.

Sean Reyes Sworn In As New Attorney General

Sean Reyes was officially sworn in as the new Attorney General of Utah today in a ceremony at the State Capitol.

In a crowded Capitol Rotunda Sean Reyes took the oath of office to become Utah’s next Attorney General. The ceremony comes less than a year after former Attorney General John Swallow took the same oath, only later to resign in the midst of several investigations into his conduct. Reyes says his first job is to restore the public’s trust in his office.

Herbert Selects Sean Reyes as Next Attorney General of Utah

Governor Gary Herbert has selected Sean Reyes to be Utah’s next Attorney General. He says all three of the candidates referred to him were qualified for the job, but ultimately it was Sean Reyes’ experience in both the public and private sector that made him the one who would fit best.

“He is eminently qualified for this responsibility and this job and I think it comes at a time that is unique in our state’s history, that’s going to take a unique personality to come in and turn the office around,” Herbert says.

Committee Report Shows AG's Office Was For Sale Under Swallow

During day two of the House Investigative Committee’s report on former Attorney General John Swallow, investigators described a web of organizations that Swallow used to hide and obscure money received from payday lending companies. Chief investigator James Mintz said he accomplished this with the help of campaign consultant Jason Powers, who created most of the shell organizations.

Members of the Utah Republican state central committee selected Sean Reyes, Robert Smith and Brian Tarbet as their nominees for Attorney General. Governor Gary Herbert will now choose one of these candidates to replace John Swallow. He says he hopes to do it as soon as possible, and hopefully before Christmas.

“I’m going to interview them, I’m going to talk with them. It’s about restoring trust in the AG’s office and confidence for the people of Utah. And I think I’ve got three great people to choose from.”

Salt Lake County District Attorney Files Charges Against Tim Lawson, Shurtleff's "Fixer"

The Salt Lake County District Attorney’s office and the Davis County Attorney’s office have filed six felony charges against Timothy Lawson. Lawson is an associate of Former Attorneys General Mark Shurtleff and John Swallow and is sometimes referred to as a “Fixer.” Salt Lake County District Attorney Sim Gill says the charges suggest Lawson engaged in consistent criminal activity.

Utah Supreme Court Upholds Decision Overturning Debra Brown's Murder Conviction

Debra Brown will remain a free woman after the Utah Supreme Court upheld a lower court’s ruling that cleared her of murder.

Brown was convicted of the murder of her boss, Lael Brown, and spent 17 years in prison. In 2011, a court applied a new state law and found she was “factually innocent.” That decision was was based partly on new testimony and partly on evidence already heard in the original trial.

Utah House Not Yet Discussing Impeachment of Attorney General

The Utah legislature is meeting this week for their monthly interim meetings but they don’t plan on discussing the fate or potential impeachment of Attorney General John Swallow.  

Speaker of the House Rebecca Lockhart says she’s concerned about the recent allegations brought against Attorney General John Swallow and that they’re looking into how the legislature might address them.

Swallow Joins Other Attorneys General Backing Immigration Reform

Utah Attorney General John Swallow is encouraging Congress to enact immigration reform.  Swallow is part of a bipartisan group of 35 Attorney Generals who sent a letter to federal leaders calling for reform that improves the immigration system, keeps communities safe and protects borders. 

Swallow says drug crime, identity theft issues, and gangs tied to illegal immigration are threatening Utah’s safety and economy.

The U.S. Supreme Court is receiving briefs from all over the country as it prepares to take up same sex marriage next month, including Utah.  The Court will hear arguments in two cases concerning the federal Defense of Marriage Act and California’s Proposition 8.  The Utah Pride Center plans to file an amicus brief to the nation’s highest court this week, arguing that laws that ban same sex marriage amount to discrimination.  But the Church of Jesus Christ of Latter-day Saints and Utah’s Attorney General have filed their own briefs in defense of traditional marriage and states’ rights to decide.

GOP Leaders Decide Not to Discuss Swallow Scandal

Utah Republican Party leaders decided to table a discussion about a scandal affecting Attorney General John Swallow over the weekend.  Swallow is being investigated by the US Attorney’s Office for allegedly helping business man Jeremy Johnson bribe US Senate Majority Leader Harry Reid. Members of the GOP State Central Committee voted against holding a formal discussion on the issue, though some say it’s one of the most important issues facing the party.

Critics Demand Investigations of Utah's Attorney General

The chorus of voices demanding an investigation of Utah's attorney general is growing.  The Alliance for a Better Utah is asking the Utah State Bar to look into accusations that Attorney General John Swallow helped to arrange a lobbying effort aimed at sidetracking a federal investigation of Internet entrepreneur Jeremy Johnson.

Alliance Director Maryann Martindale says, if what Johnson has been saying is true, Swallow could have violated ethical standards.
